Terms of Service

These terms govern your use of lexuswell.com and any purchase you make from us. By using this site or placing an order you agree to them. Please read them before you buy.

This store is operated by eTechFlow LLC, registered at 18121 E Hampden Ave, Unit C, Aurora, Colorado 80013, United States. Throughout the site the terms "we", "us" and "our" refer to eTechFlow LLC.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering you confirm you meet that requirement and that the information you give us is accurate.

2. Products

We sell fragrance and cosmetic products. We make every effort to display colours, packaging and product images accurately, but we cannot guarantee your screen shows them exactly as they appear in person.

Product descriptions, including ingredient and benefit information, are provided for general information. They are not medical advice and are not intended to diagnose, treat, cure or prevent any condition. If you have a skin condition, allergy or are pregnant, consult a qualified professional before use. Always patch test a new product before full use.

We may change or discontinue any product at any time without notice.

3. Pricing and errors

All prices are in US dollars and exclude any applicable sales tax, which is calculated at checkout. Prices may change without notice.

Comparison prices shown alongside our own price refer to typical prevailing retail prices for the same item and are provided as a reference point.

Despite our best efforts, a product may occasionally be listed at an incorrect price or with incorrect information. We reserve the right to cancel and refund any order placed at an incorrect price, whether or not the order has been confirmed or payment taken. If we cancel, we will notify you and refund in full.

4. Orders and acceptance

Your order is an offer to buy. A confirmation email acknowledges receipt of your order, it does not constitute acceptance. Acceptance occurs when we dispatch the goods.

We reserve the right to refuse or limit any order, including orders that appear to be for resale, orders that fail our fraud checks, and multiple orders placed to the same address or with the same payment method where quantity limits apply.

5. Payment

We accept major credit and debit cards and the digital wallets shown at checkout. Payment is processed by our payment provider over an encrypted connection. We do not receive or store your full card details.

By submitting payment information you confirm you are authorised to use the payment method.

6. Shipping and delivery

We ship to addresses within the United States only. Delivery timeframes, costs and dispatch cut-offs are set out in our Shipping Policy, which forms part of these terms.

Fragrances are classified as flammable goods and travel by ground rather than air. This is a carrier regulation and may extend delivery times.

Risk of loss passes to you when the carrier takes possession. Where a parcel is lost or damaged in transit, contact us and we will resolve it as set out in our Shipping Policy.

You are responsible for entering a correct delivery address. We cannot redirect a parcel once dispatched.

7. Returns

Returns are governed by our Refund Policy, which forms part of these terms. In summary, unopened items may be returned within 30 days of delivery, and faulty or damaged items may be returned at any reasonable time. Opened fragrance and skincare cannot be returned unless faulty, for hygiene reasons.

Nothing in these terms limits your rights under applicable consumer protection law.

8. Accounts

If you create an account you are responsible for keeping your password confidential and for all activity under your account. Notify us immediately of any unauthorised use.

9. Acceptable use

You agree not to use this site for any unlawful purpose, to attempt to gain unauthorised access to it, to interfere with its operation, to scrape or harvest data from it, or to submit false or misleading information.

10. Intellectual property

The design, text, graphics and arrangement of this site are owned by us or our licensors and may not be reproduced without written permission.

All third party brand names, product names, trademarks and logos are the property of their respective owners. Their use on this site identifies the goods we sell and does not imply any affiliation with, sponsorship by, or endorsement from those brand owners.

11. Third party links

This site may link to third party websites we do not control. We are not responsible for their content, products or privacy practices.

12. Disclaimer of warranties

This site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not warrant that the site will be uninterrupted, secure or error free.

13. Limitation of liability

To the fullest extent permitted by law, our total liability arising out of or relating to any order or your use of this site will not exceed the amount you paid for the order in question.

We will not be liable for indirect, incidental, special or consequential losses, including lost profits or lost data.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded by law.

14. Indemnity

You agree to indemnify us against any claim arising from your breach of these terms or your misuse of this site.

15. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, supplier failure, extreme weather, or acts of government.

16. Governing law

These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict of law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Arapahoe County, Colorado for any dispute arising from these terms.

17. Changes to these terms

We may update these terms at any time. The version published on this page at the time you place an order is the version that applies to that order. Please review this page periodically.

18. Severability

If any provision of these terms is found unenforceable, the remaining provisions continue in full effect.
